(hereinafter "the Seller", "we", "us").
2. Scope and acceptance
These Terms and Conditions of Sale (hereinafter "the Terms") govern every sale concluded through the Store between the Seller and any natural person acting for purposes outside their trade, business or profession (hereinafter "the Customer", "you").
Placing an order on the Store implies full and unreserved acceptance of these Terms. The Customer is invited to read them carefully before validating any order. The Terms applicable are those in force on the date the order is placed.
The Seller reserves the right to modify these Terms at any time. Modifications do not apply to orders already placed.
3. Customers and use of the products
3.1 The Store is intended exclusively for consumers within the meaning of the introductory article of the French Consumer Code, i.e. natural persons acting for purposes that do not fall within the scope of a commercial, industrial, craft, liberal or agricultural activity.
3.2 The Customer declares that they are at least 18 years of age and have full legal capacity to contract, or that they are acting with the authorisation of their parent or legal guardian.
3.3 The products are sold for personal use. The Store does not offer wholesale.
3.4 As stock is limited, orders are limited to 5 units per product, all sizes and variants combined, per order.
3.5 The Seller reserves the right to cancel any order placed in breach of Sections 3.1, 3.3 or 3.4, or that is manifestly intended for resale. The Customer is informed by email and refunded in full without undue delay, to the exclusion of any other compensation.
3.6 Professional enquiries (resellers, stores, volume orders) are handled exclusively on a quote basis at contact@altarvision.com and are subject to separate terms. They benefit neither from the right of withdrawal nor from the consumer mediation scheme, which are reserved for consumers.
4. Products
The Store sells the following products:
| Product | Composition |
|---|---|
| Plush toy (approx. 20 cm high) | 100% polyester (fabric and stuffing) |
| Sweatshirt | 100% cotton (French terry) |
| Pants | 100% cotton (French terry) |
| T-shirt | 100% cotton |
Each product is described on its product page (composition, sizing, care instructions, price). The products are standard items; no customisation is offered. Product photographs are as accurate as possible; however, slight variations in colour may occur depending on the Customer's screen and do not constitute a lack of conformity.
Products are offered within the limits of available stock. Should a product become unavailable after an order has been placed, the Seller will inform the Customer by email and refund the amount paid for that product without delay.
5. Prices
Prices are set in euros (EUR). For the Customer's convenience, the Store may display prices in the local currency of the Customer's country; the amount charged is the one displayed at checkout. Any exchange fees applied by the Customer's bank or payment provider are borne by the Customer.
VAT is not applicable to the Seller's sales (Article 293 B of the French General Tax Code).
Shipping costs are not included in product prices. They are fixed amounts depending on the destination, the shipping method selected and the weight of the parcel, and are displayed to the Customer before the order is validated. Any free shipping offer applies under the conditions stated on the Store at the time of the order (in particular in the Shipping Policy).
Import duties, customs fees and any taxes or charges legally payable by the Customer upon importation are not included in the price and remain the Customer's responsibility (see Section 9).
The Seller reserves the right to change its prices at any time. Products are invoiced at the price in force at the time the order is validated.
6. Orders
To place an order, the Customer selects the desired products, adds them to the cart, then follows the checkout steps: delivery details, shipping method, payment method, and verification of the order summary. The order is final once payment has been validated.
The Seller sends an order confirmation email to the address provided by the Customer. This email constitutes acceptance of the order and concludes the sales contract.
The Customer is responsible for the accuracy of the information provided (in particular the delivery address). The Seller cannot be held liable for a failed delivery caused by incorrect or incomplete information.
Cancellation before shipment. The Customer may cancel their order free of charge as long as it has not been marked as fulfilled (shipped) by the Seller, either from their customer account on the Store or by email to contact@altarvision.com quoting the order number. The Seller then refunds all sums paid without undue delay, to the original payment method. Once the order has been fulfilled, it can no longer be cancelled or modified; the Customer may then exercise the right of withdrawal described in Section 10 after receiving the products.
The Seller reserves the right to refuse or cancel any order in the event of a payment issue, suspected fraud, abnormal order volume, breach of Section 3, or a previous dispute with the Customer.
7. Payment
Payment is due in full at the time of ordering. The Store accepts the payment methods offered at checkout by the Shopify platform (in particular major credit/debit cards and express payment methods such as Apple Pay, Google Pay or Shop Pay, depending on availability in the Customer's country).
Payments are processed by secure third-party providers. The Seller never has access to the Customer's full banking data.
Orders are shipped only after payment has been confirmed.
8. Delivery
8.1 Delivery countries
All orders are shipped from France. The Store delivers to the following countries only:
- European Union: France (metropolitan), Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Ireland, Italy, Lithuania, Luxembourg, Malta, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden
- United States
- Canada
- Australia
- New Zealand
- Switzerland
Orders with a delivery address outside these countries cannot be accepted.
Some products may not be available for delivery to certain countries. Availability for the Customer's destination is shown on the Store and at checkout. Should an order nevertheless be placed for a product that is not available for delivery to the destination country, the Seller will inform the Customer by email and refund the amount paid for that product without delay.
8.2 Preparation, carriers and delivery times
Orders are prepared and handed over to the carrier within 2 to 3 business days after payment confirmation. The Customer receives a shipping confirmation email, with tracking information where available.
Parcels are shipped by one of the following carriers, depending on the destination and the option selected at checkout: Colissimo, Chronopost, Mondial Relay, FedEx.
Pickup point delivery. Where the Customer selects a pickup point delivery option, the pickup point is chosen on the order confirmation page displayed after payment. If no pickup point is chosen, the parcel is sent to the pickup point closest to the delivery address.
Indicative delivery times, from the shipping confirmation email:
- France (metropolitan): 1 to 7 business days depending on the shipping method selected (express: 1 to 2 business days)
- International: 8 to 24 business days
These times are given for information only. They do not include customs clearance times, which are outside the Seller's control. In all cases, and in accordance with Article L.216-1 of the French Consumer Code, delivery will take place no later than 30 days after the order is placed, unless a different date has been communicated to the Customer.
If the product has not been delivered on the agreed date or, failing that, within 30 days of the order, the Customer may, after having asked the Seller to deliver within a reasonable additional period without success, cancel the contract by registered letter with acknowledgement of receipt or in writing on another durable medium. The Seller will then refund the Customer within 14 days.
8.3 Receipt of the parcel
The Customer is invited to check the condition of the parcel and the products upon delivery. In the event of a damaged parcel or missing product, the Customer is advised to note precise reservations with the carrier and to inform the Seller as soon as possible at contact@altarvision.com, with photographs where possible, so that the matter can be dealt with quickly. This recommendation does not affect the Customer's legal rights.
The risk of loss or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer (other than the carrier), physically takes possession of the products (Article L.216-4 of the French Consumer Code).
If a parcel is returned to the Seller due to an incorrect address provided by the Customer, or because it was not collected within the carrier's holding period, re-shipping costs are borne by the Customer.
9. Customs duties, import taxes and local fees
For deliveries outside the European Union, and to territories of the European Union located outside its VAT area (such as the Canary Islands), the products may be subject to import duties, customs fees and other taxes or charges levied by the destination country upon importation. Import duties, customs fees and any taxes or charges that are legally payable by the Customer upon importation are not included in the product price or the shipping costs and remain the Customer's responsibility, the Customer being the importer of record. Where the law of the destination country requires the Seller itself to collect a tax on the sale, that tax will be shown and charged at checkout.
These charges are collected by the customs authorities or the carrier at the time of delivery. The Seller has no control over their amount and cannot estimate them in advance. The Customer is invited to contact their local customs office for more information before ordering.
Refused or unclaimed parcels. If a parcel is refused, not collected, or returned to the Seller because these charges were not paid, the order is cancelled. Once the parcel has been received back by the Seller, the Customer is refunded the price of the products and the standard outbound shipping costs, less (i) the return shipping costs charged to the Seller by the carrier and (ii) any duties, taxes, customs clearance, storage or handling fees charged to the Seller. If these costs are equal to or greater than the amount to be refunded, no refund is due.
If the parcel is abandoned or destroyed by the carrier or the customs authorities and is not returned to the Seller, no refund is due.
Any refund is made within 14 days of receipt of the returned parcel, using the original payment method. This clause applies without prejudice to the Customer's mandatory legal rights, including the right of withdrawal (Section 10).
10. Right of withdrawal
10.1 Principle
Under Articles L.221-18 et seq. of the French Consumer Code, the Customer has a right to withdraw from the contract, without giving any reason, within 14 days from the day on which the Customer (or a third party designated by the Customer, other than the carrier) takes physical possession of the product. For an order of several products delivered separately, the period runs from receipt of the last product.
The Seller voluntarily extends this right of withdrawal to all Customers, regardless of their country of delivery, under the same conditions.
10.2 How to exercise the right of withdrawal
To exercise this right, the Customer must notify the Seller of their decision to withdraw by an unambiguous statement before the 14-day period expires, using one of the following means:
- Online withdrawal function: the Customer may exercise their right of withdrawal online at https://shop.altarvision.com/pages/withdrawal (link "Cancel your order / Renoncer au contrat ici" available in the Store's footer and in the order confirmation email). If the Customer uses this online function, the Seller will send them without delay an acknowledgement of receipt of the withdrawal on a durable medium (by email), including its content and the date and time of its submission.
- By email to contact@altarvision.com, mentioning the order number. The Customer may use the model withdrawal form in the Appendix, but this is not mandatory.
- By post to the address given in Section 1.
In all cases, the Seller will acknowledge receipt of the withdrawal request by email and provide the return instructions. The burden of proof of exercising the right of withdrawal lies with the Customer.
10.3 Returning the products
The Customer must return the products to the Seller without undue delay and no later than 14 days after communicating their decision to withdraw, to the following address:
Léo Prudhomme
2375 route de Senjulia
64220 Jaxu, France
The direct cost of returning the products is borne by the Customer, including any customs or import fees applicable to the return. The Customer is advised to use a tracked shipping method; the products travel at the Customer's risk until they are received by the Seller.
Products should be returned unworn, unwashed, unused, in their original condition, complete, with all labels and tags attached, and, where possible, in their original packaging. The Customer may handle and inspect the products only to the extent necessary to establish their nature, characteristics and functioning as they would in a physical store (trying on a garment is permitted; wearing or washing it is not). The Customer remains free to withdraw even if the products have been handled beyond this, but is then liable for the resulting diminished value of the products; the Seller may deduct the corresponding amount from the refund, up to the full price of the product where it can no longer be resold.
10.4 Refund
The Seller will refund all sums paid by the Customer for the returned products, including the standard outbound shipping costs (the least expensive delivery option offered by the Seller; any extra cost for a faster option chosen by the Customer is not refunded), without undue delay and no later than 14 days from the day the Seller is informed of the decision to withdraw. The Seller may defer the refund until it has received the products or until the Customer has provided proof of shipment, whichever comes first.
The refund is made using the same payment method as the one used for the order, unless the Customer expressly agrees otherwise. Customs duties and import taxes paid by the Customer to the authorities of the destination country are not refunded by the Seller.
11. Returns, exchanges and refunds outside the right of withdrawal
Outside the right of withdrawal (Section 10) and the legal warranties (Section 12), no return, exchange or refund is accepted. In particular, products cannot be returned or refunded after the 14-day withdrawal period for reasons of size, preference or change of mind. Customers are invited to consult the size guides on the product pages before ordering.
For any question regarding returns, the Customer may contact the Seller at contact@altarvision.com.
12. Legal warranties
Independently of the right of withdrawal, all products sold on the Store benefit from the legal warranties provided for by French law:
- the legal warranty of conformity (Articles L.217-3 to L.217-20 of the French Consumer Code);
- the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
The Seller does not offer any commercial warranty in addition to these legal warranties.
The conditions and remedies of these warranties (repair, replacement, price reduction or refund, time limits) are those set out in the mandatory information box below, which prevails over any summary.
To invoke a warranty, the Customer must contact the Seller at contact@altarvision.com, describing the defect and providing photographs. Return shipping costs for a product found to be non-conforming or defective are borne by the Seller.
Mandatory information (Article D.211-2 of the French Consumer Code):
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
The legal warranty of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal warranty of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without any major inconvenience for them.
If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer asks for the goods to be repaired, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund against return of the goods, if: 1° the professional refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes a major inconvenience for the consumer, in particular when the consumer definitively bears the cost of taking back or removing the non-conforming goods, or if they bear the cost of installing the repaired or replacement goods; 4° the non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to terminate the contract when the lack of conformity is so serious that it justifies the immediate reduction of the price or termination of the contract. The consumer is then not required to first request the repair or replacement of the goods.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty period until the delivery of the repaired goods.
The rights mentioned above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who obstructs the implementation of the legal warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (Article L.241-5 of the French Consumer Code).
The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
Customers residing outside France also benefit from any mandatory consumer protection provisions of the law of their country of residence (for example the Australian Consumer Law, the New Zealand Consumer Guarantees Act, or applicable Canadian provincial legislation). Nothing in these Terms limits or excludes such rights.
13. Promotional codes
Promotional codes issued by the Seller are valid for the period and under the conditions stated when they are communicated. Unless expressly stated otherwise, promotional codes cannot be combined with each other or with any other ongoing offer. Only one code may be used per order. Promotional codes have no cash value and cannot be applied retroactively to an order already placed.
14. Liability
The Seller is bound by an obligation of means for all stages of access to the Store, the ordering process and delivery. The Seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a service interruption, an external intrusion or the presence of computer viruses, or for any event qualified as force majeure within the meaning of Article 1218 of the French Civil Code.
The Seller cannot be held liable for delays or failures in delivery attributable to the carrier, to customs procedures, or to incorrect information provided by the Customer.
The Customer is solely responsible for the choice of products and their suitability for their needs.
15. Intellectual property
All elements of the Store and of the products (brand names, logos, designs, illustrations, characters, texts, photographs, 3D models, videos, music) are the exclusive property of the Seller or its licensors and are protected by intellectual property law. Any reproduction, representation, modification or exploitation, in whole or in part, without the prior written authorisation of the Seller is prohibited. The purchase of a product does not transfer any intellectual property rights to the Customer.
16. Personal data
The Customer's personal data is processed by the Seller for the purpose of managing orders, deliveries, customer relations and, subject to the Customer's consent, marketing communications. The conditions of processing, the retention periods and the Customer's rights (access, rectification, erasure, objection, portability, etc.) are set out in the Store's Privacy Policy, accessible from the Store's footer.
17. Environmental information - Extended Producer Responsibility
In accordance with Article L.541-10-13 of the French Environmental Code, the Seller is registered with the following eco-organisations and holds the following unique identifiers (IDU):
| Sector | Eco-organisation | Unique identifier (IDU) |
|---|---|---|
| Household packaging | Citeo | FR543792_01IPJM |
| Toys | Ecomaison | FR543792_12LLEI |
| Textiles, household linen and footwear | Refashion | FR543792_11HMYG |
Customers are invited to sort and recycle packaging and end-of-life products in accordance with the rules in force in their country.
18. Complaints, mediation and disputes
18.1 Prior complaint
For any complaint, the Customer is invited to contact the Seller first, by email at contact@altarvision.com or by post at the address given in Section 1. The Seller undertakes to respond as quickly as possible.
18.2 Consumer mediation
In accordance with Articles L.611-1 et seq. and L.616-1 of the French Consumer Code, if a written complaint to the Seller has not been resolved within two months, the Customer may refer the dispute free of charge to the consumer mediator designated by the Seller:
CM2C - Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
Website: https://www.cm2c.net (online dispute form: https://www.cm2c.net/declarer-un-litige.php)
Email: cm2c@cm2c.net
Phone: +33 1 89 47 00 14
The mediator may only be seized if the Customer can show that they have first attempted to resolve the dispute directly with the Seller by a written complaint, that the dispute is not being examined by a court or another mediator, and that the request is neither manifestly unfounded nor abusive. The mediation process is confidential and free of charge for the consumer.
18.3 Applicable law and jurisdiction
These Terms and any sale concluded through the Store are governed by French law.
In the event of a dispute, and failing an amicable solution, the competent courts are those designated by the applicable rules of jurisdiction. A Customer residing in France may bring an action before the court of the place where they resided at the time the contract was concluded or of the place where the harmful event occurred. Customers residing outside France retain the benefit of the mandatory provisions and jurisdiction rules of the law of their country of residence.
19. Language
These Terms are available in English and in French. In the event of any discrepancy between the two versions, the French version shall prevail. (Until the French version is published, the English version is the sole reference.)
20. Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The Seller's failure to enforce any provision of these Terms at any time shall not be construed as a waiver of its right to do so in the future.
